Article 1: Purpose
These Terms of Sale govern the sale of credits used to generate AI tattoo animation videos on encrevive.com. They supplement the Terms of Use. In the event of any conflict regarding a purchase, these Terms of Sale prevail.
Article 2: Seller and Merchant of Record
The service is operated by Claude Gironde, a sole trader (see Legal Notice). Payments are processed by Lemon Squeezy, LLC, acting as Merchant of Record (authorized reseller). As such, Lemon Squeezy is the registered seller of record for the transaction: it issues the invoice, collects the payment, and handles applicable taxes based on the customer's country.
Article 3: Products and pricing
The service runs on credits:
- 1 credit generates a 5-second video.
- A 10-second video costs 2 credits.
- 2 credits are granted for free on sign-up, with no purchase or payment card required.
- Pack: 10 credits for €7.99 (incl. tax), as a one-time payment, no subscription. Purchased credits never expire.
Prices are shown in euros, taxes included. The exact tax amount is calculated and shown by Lemon Squeezy at checkout, based on the customer's country.
Article 4: Order
From the Studio, the customer selects the credit pack and is redirected to Lemon Squeezy's secure checkout. The order is confirmed once payment is validated.
Article 5: Payment
Payment is made exclusively through Lemon Squeezy, using the payment methods on its secure checkout. Encre Vive neither collects nor stores any payment card data.
Article 6: Delivery
Credits are a digital good. They are credited instantly to the customer's account once payment is confirmed. No physical medium is provided.
Article 7: Right of withdrawal
In accordance with EU consumer law (Directive 2011/83/EU, art. 16(m), and French Consumer Code art. L221-28), the right of withdrawal does not apply to the supply of digital content not on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgment that the right of withdrawal is thereby lost.
By completing the purchase, the customer:
- expressly requests immediate performance (credits available as soon as payment is made);
- acknowledges and agrees to waive the right of withdrawal once the credits are made available.
Purchased but unused credits remain refundable as a goodwill measure under the Refund Policy.
Article 8: Refunds
Refund conditions are detailed in the Refund Policy.
Article 9: Warranty and liability
The service is provided "as is". If a generation fails for a technical reason attributable to Encre Vive, the corresponding credit is automatically re-credited to the customer's account. Encre Vive does not guarantee any specific artistic outcome.
Article 10: Personal data
Data processing is described in the Privacy Policy.
Article 11: Governing law and disputes
These Terms of Sale are governed by French law. Customers may use a consumer mediator free of charge, or the EU online dispute resolution platform: https://ec.europa.eu/consumers/odr.
